Terms of service

1. Agreement

These Terms of Service (“Terms”) govern access to Wishfo’s website, Shopify application, and related customer-enrichment services (“Services”). Wishfo is operated by Trevbag LLC d/b/a Wishfo. By installing, accessing, or using the Services, you agree to these Terms on behalf of yourself and the merchant organization you represent.

2. The Services

Wishfo helps merchants identify eligible customer records, search for contact information through a multi-source enrichment waterfall, verify candidate email deliverability, and send verified profiles to a merchant-authorized Klaviyo account and list. Wishfo does not replace Shopify order or customer email fields.

Availability, match rates, and deliverability results vary. A verification result is a point-in-time assessment and does not guarantee delivery, inbox placement, customer identity, campaign performance, or future validity.

3. Merchant responsibilities

You represent and warrant that you will:

• Use the Services only for lawful, legitimate business purposes.
• Have all rights and lawful bases needed to submit and process data.
• Provide legally required privacy notices and honor customer rights.
• Comply with applicable privacy, consumer-protection, anti-spam, and marketing laws, including consent and opt-out requirements.
• Maintain the security of your Shopify account and authorized users.
• Review automation and retention settings appropriate for your business.

Wishfo does not grant permission to send marketing communications. Enrichment of an email address does not create consent, and Wishfo does not expand consent beyond the status supplied by Shopify. Existing Klaviyo opt-outs and suppressions remain authoritative.

4. Prohibited use

You may not use the Services to:

• Violate law, regulation, platform policy, or another person’s rights.
• Build or sell an unrelated database of personal information.
• Harass, discriminate against, deceive, or unlawfully profile individuals.
• Send unlawful unsolicited communications or evade opt-outs.
• Probe, disrupt, reverse engineer, or circumvent the Services.
• Share access credentials or resell the Services without permission.

5. Plans, credits, and billing

Plan prices, included volumes, overage rates, and billing intervals are displayed before purchase. A standard Wishfo credit is consumed only when a new candidate email meets Wishfo’s billable verification criteria. Failed lookups and qualifying recent duplicate matches do not consume a standard credit.

Shopify-distributed app charges are administered through the applicable Shopify billing workflow. You authorize the charges you approve. Taxes may apply. Unless required by law, consumed credits and completed billing periods are non-refundable. You can change plans through the app subject to the terms shown at checkout.

6. Customer data

As between you and Wishfo, you retain your rights in merchant and customer data. You instruct Wishfo to process that data solely to provide and support the Services, maintain security, comply with law, and as otherwise described in our Privacy Policy.

7. Intellectual property

Wishfo and its licensors own the Services, software, interfaces, documentation, trademarks, and related intellectual property. These Terms provide a limited, non-exclusive, non-transferable right to use the Services during your authorized subscription. Feedback may be used without restriction or obligation.

8. Availability and changes

We may improve, modify, suspend, or discontinue features, including the composition and order of our enrichment waterfall. We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. Third-party platform or data-provider changes may affect availability.

9. Suspension and termination

You may stop using the Services and uninstall the application at any time. We may suspend or terminate access for material breach, security risk, unlawful use, nonpayment, or conduct that threatens merchants, customers, Wishfo, or its providers. Provisions that by nature should survive termination will survive.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WISHFO DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHFO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. WISHFO’S TOTAL LIABILITY ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO WISHFO IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You will defend and indemnify Wishfo and its affiliates, officers, and personnel from claims, damages, and expenses arising from your data, unlawful use of the Services, communications sent using enriched information, or breach of these Terms.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. The parties consent to exclusive jurisdiction and venue in the state and federal courts located in Orange County, California.
