Terms of service

1. Agreement and authority

These Terms of Service (the “Terms”) govern access to Wishfo’s website, Shopify application, and related customer-data enhancement services (the “Services”). Wishfo is operated by Trevbag LLC d/b/a Wishfo (“Wishfo,” “we,” “us,” or “our”).

By installing, accessing, accepting these Terms, or using the Services, you agree to these Terms on behalf of yourself and the merchant organization you represent (“Merchant,” “you,” or “your”). You represent that you are at least 18 years old and have authority to bind the Merchant. If you do not agree, do not use the Services.

2. Shopify and third-party services

Wishfo is an independent application and is not Shopify. Your use of Shopify, Klaviyo, and other connected services remains governed by their respective agreements and policies. Those providers may change, restrict, suspend, or discontinue their services, APIs, or access. Wishfo is not responsible for third-party services or for their acts, omissions, availability, or security.

3. The Services

Wishfo helps Merchants identify eligible Shopify order records with missing or unusable customer email addresses, search for potential contact information through authorized data providers, verify candidate email deliverability, and send qualifying profiles to a Merchant-authorized Klaviyo account and list. Wishfo does not replace the email address stored on the Shopify order or customer record.

Match rates and results vary. A verification result is a point-in-time technical assessment and does not guarantee identity, delivery, inbox placement, campaign performance, consent, or future validity. You are responsible for reviewing whether the Services and their configuration are appropriate for your business.

4. Account, installation, and access

You must maintain an active, authorized Shopify store and keep all connected accounts and credentials secure. You are responsible for actions taken through your account and for ensuring that only authorized personnel use the Services. Tell us promptly if you suspect unauthorized access. We may rely on instructions submitted through your authenticated Shopify account.

5. Merchant responsibilities

You represent, warrant, and agree that you will:

• Use the Services only for lawful, legitimate business purposes.
• Have all rights, notices, permissions, and lawful bases needed for the personal information you direct Wishfo to process.
• Comply with applicable privacy, consumer-protection, anti-spam, telemarketing, and marketing laws and platform policies.
• Honor customer rights, opt-outs, objections, and suppression requests and maintain accurate privacy notices.
• Review your automation, confidence, destination, retention, billing, and historical-processing settings.

Wishfo does not grant permission or provide a lawful basis to contact anyone. Finding or verifying an email address does not create marketing consent. Wishfo preserves the Shopify marketing-consent state it receives and does not override Klaviyo suppressions, but you remain responsible for the communications you send.

6. Merchant data and processing instructions

As between the parties, you retain your rights in data you make available through Shopify or other connected services (“Merchant Data”). You instruct Wishfo to process Merchant Data to provide, secure, support, and improve the Services; comply with your lawful settings and instructions; prevent fraud and abuse; and comply with law, as further described in our Privacy Policy.

You are responsible for the legality, quality, and accuracy of Merchant Data and for responding to individuals whose information you control. You may not provide data that the Services are not designed or authorized to process, including sensitive personal information unless Wishfo expressly agrees in writing.

7. Acceptable use

You may not use the Services to:

• Violate law, regulation, platform policy, or another person’s rights.
• Build, sell, or enrich an unrelated database of personal information.
• Harass, discriminate against, deceive, or unlawfully profile anyone.
• Send unlawful unsolicited communications or evade opt-outs.
• Introduce malicious code; probe, disrupt, overload, scrape, or bypass security or usage restrictions.
• Reverse engineer, copy, resell, sublicense, or provide the Services to third parties except as expressly permitted by law or by Wishfo.

8. Plans, included resolutions, and metered overages

Current plan prices, included monthly volumes, billing intervals, and overage rates are displayed before purchase. A billable resolution occurs only when Wishfo returns a verified, unique email resolution under the criteria shown in the app. No matches, failed verification, provider errors, and qualifying duplicate identities are not billable resolutions.

“Pause and notify” is the default at the included plan limit. New eligible orders move to Pending unless you affirmatively upgrade or enable metered overages at the displayed rate. Wishfo will not silently enable overage billing. You may disable forward-looking overages in the app, subject to charges already incurred before the change takes effect.

9. Historical processing

Wishfo does not automatically process orders from before the authorized forward-processing start date. A historical scan may inventory eligible records as Pending, but paid historical resolution requires a separate, express Merchant approval and a Merchant-selected maximum charge. Purchasing a plan, restoring credits, or enabling forward-looking overages does not automatically resume a historical backlog.

10. Billing, renewal, taxes, and refunds

Shopify-distributed charges are presented and administered through the applicable Shopify billing workflow. You authorize only charges you approve there or through an express in-app metered-usage or batch authorization. Subscriptions renew for the interval displayed at checkout until canceled or changed in accordance with the available Shopify billing controls.

Prices exclude applicable taxes unless stated otherwise. You are responsible for applicable taxes and valid billing information. Except where required by law or expressly stated at checkout, completed billing periods and consumed billable resolutions are non-refundable. Plan changes, cancellation timing, and any prorating are handled as displayed in the Shopify billing flow.

11. Privacy, security, and confidentiality

Our Privacy Policy explains how Wishfo handles personal information. We use reasonable administrative, technical, and organizational safeguards designed to protect data, but no system is completely secure. Each party will protect the other party’s non-public confidential information using reasonable care and use it only to perform or receive the Services, except as required by law or expressly authorized.

12. Intellectual property and license

Wishfo and its licensors own the Services, software, interfaces, documentation, trademarks, and related intellectual property. During your authorized use, Wishfo grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Services for your internal business purposes. No other rights are granted. If you provide feedback, you grant Wishfo a perpetual, worldwide, royalty-free right to use it without restriction or obligation.

13. Service changes and availability

We may maintain, improve, modify, or discontinue features, including the composition and order of the enrichment waterfall. We aim to provide a reliable service but do not guarantee uninterrupted, secure, or error-free operation. Planned and emergency maintenance, provider failures, Internet conditions, and changes to Shopify, Klaviyo, or data-provider services may affect availability.

14. Suspension and termination

You may stop using the Services and uninstall the app at any time. We may suspend or terminate access for material breach, security risk, unlawful or abusive use, nonpayment, a third-party platform requirement, or conduct that threatens customers, Merchants, Wishfo, or its providers. When access ends, your right to use the Services ends. Data deletion and retention follow our Privacy Policy and applicable Shopify requirements. Provisions that by their nature should survive will survive, including payment obligations, intellectual property, disclaimers, liability limits, indemnity, and dispute provisions.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WISHFO DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WISHFO DOES NOT WARRANT THAT ANY MATCH IDENTIFIES THE CORRECT PERSON OR THAT ANY EMAIL IS OR REMAINS DELIVERABLE, LAWFUL TO USE, OR SUITABLE FOR YOUR PURPOSE.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHFO AND ITS AFFILIATES, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. WISHFO’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO WISHFO IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS. THESE LIMITS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

17. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Wishfo and its affiliates, officers, directors, employees, and agents from third-party claims, damages, liabilities, penalties, and reasonable costs arising from Merchant Data; your communications or marketing; your unlawful or unauthorized use of the Services; your violation of another person’s rights; or your breach of these Terms. Wishfo will provide reasonable notice and cooperation, and you may not settle a claim in a way that admits fault by or imposes obligations on Wishfo without our written consent.

18. Changes to these Terms

We may update these Terms to reflect changes in law, the Services, or our practices. We will post the revised Terms and effective date. If a change is material, we will provide notice as appropriate and may require you to accept the updated version before continuing to use the Services. Continued use after an update takes effect constitutes acceptance where permitted by law.

19. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. The parties consent to exclusive jurisdiction and venue in the state and federal courts located in Orange County, California. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.

20. General terms

Neither party is liable for delay or failure caused by events beyond its reasonable control. You may not assign these Terms without our written consent; Wishfo may assign them in connection with a merger, acquisition, reorganization, or sale of assets. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. Headings are for convenience. These Terms, the Privacy Policy, and any terms presented in an approved Shopify billing flow are the entire agreement concerning the Services and supersede prior discussions about their subject matter. Notices and transactions may be provided electronically.
